Panau Official Constitution


Section 1 – Crimes against the person
1.1Assault
3rd Degree – any violence causing injury to someone
2nd Degree – A violent attack on a person causing penetrative wounds or blood injury
1st Degree – A violent attack on a person causing internal damage or life-long damage
1.2 - Murder
3rd Degree – Involuntary Manslaughter – where a person is killed as a result of your actions, although unintentional
2nd Degree – Voluntary Manslaughter – where you intentially take the life of another person, although not premeditated
1st Degree – Murder – Voluntarily killing another person with malicious aforethought
1.3 - Sexual Assault
2nd Degree – Sexual gestures or actions against another person who did not consent
1st Degree – Having intercourse with a person who did not consent to it.
1.4 - False Imprisonment
3rd Degree - depriving someone of freedom of movement by holding a person in a confined space or by physical restraint due to their trespass or criminal behaviour
2nd Degree - depriving someone of freedom of movement by holding a person in a confined space or by physical restraint with no premeditation
1st Degree - depriving someone of freedom of movement by holding a person in a confined space or by physical restraint with malicious aforethought
1.5 - Hate Crime - When a crime is believed to be motivated by hostility based on a personal characteristic of the victim
1.6 - Harassment
2nd Degree - the act of systematic and/or continued unwanted and annoying actions of one party or a group.
1st Degree - the act of systematic and/or continued unwanted and annoying actions of one party or a group, including threats and demands.

Section 2 – Crimes against property
2.1Trespass – Entering any building or land without the permission of the owner
2.2Theft – Dishonest taking of property belonging to another with the intent to permanently deprive (does not include intellectual property)
2.3Taking without consent – Dishonest taking of property belonging to another with no intent to permanently deprive
2.4Vandalism – Defacing a piece of property belonging to another.
2.5Breaking and Entering – Causing damage to someone else’s property in order to gain access without consent
2.6Arson - Willfully and maliciously burning or charring of property

Section 3 – Crimes against the state
3.1Acts of War – Any action that could be deemed as action of war
3.2Instigating a riot – Rallying or performing actions which, directly or indirectly, caused civil revolt
3.3Assault of an official – Includes violent assault on politicians or government officials
3.4Treason – Attempted or successful murder of Panau’s leader
3.5 - Perverting the course of justice - lying to any official in order to attempt to alter the judgement
3.6 - Illegal Substances*
    3.6.1 - Possession for personal use of Class C substances
    3.6.2 - Possession with intent to supply of Class C substances
    3.6.3 - Possession for personal use of Class B substances
    3.6.4 - Possession with intent to supply of Class B substances
    3.6.5 - Possession for personal use of Class A substances
    3.6.6 - Possession with intent to supply of Class A substances
    3.6.7 - Creation/Production of any form of controlled substance
    3.6.8 - Any attempt, successful or otherwise, to import any controlled substance
3.7 - Prostitution
    3.7.1 - Persistent loitering in order to sell sexual services to another
    3.7.2 - Paying someone in order to obtain their sexual services
    3.7.3 - Accepting payment in exchange for a sexual service
    3.7.4 - Inciting another into prostitution for gain
    3.7.5 - Brothel-keeping (the act of managing a place for illicit sexual exchanges)

Section 4 – Legal Rights
4.1 - The right to Free speech – everyone has the right to an opinion which they are allowed to voice
4.2 - The right to Information – Any person can ask for information about a publicly funded service and the information must be released
4.3 - The right to Life, Liberty and Security
4.4 - The right to be free from slavery or forced service
4.5 - The right to be recognised as a person by the law and to be protected equally by the law
4.6 - The right to be protected against arbitrary arrest, detention or exile
4.7 - The right to be seen as innocent until proven guilty in the eyes of the law
4.8 - The right to marriage, whether to someone of the same sex or otherwise, where both parties consent
4.9 - The right to ownership of property
4.10 - The right to freedom of assembly
4.11 - Everyone has the right to take part in the government of Panau
4.12 - The right to work and freedom of choice in employment
4.13 - The right to rest and leisure
4.14 - The right to standard of living appropriate to himself and his family
4.15 - Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set
